These Terms and Conditions (hereinafter, "Terms") govern the access and use of the Smalted platform (hereinafter, "the Platform"). By accessing, registering, or using the services offered by the Platform, you (hereinafter, "the User") acknowledge that you have read, understood, and accepted these Terms. If you do not agree with any of the terms stated herein, you must refrain from using the Platform.
2. User Obligations
The User agrees to:
- Use the Platform responsibly, respecting applicable laws and the rights of third parties.
- Provide truthful and accurate information during registration and maintain the confidentiality of their access credentials.
- Refrain from publishing content that:
- Is illegal, defamatory, obscene, offensive, or promotes hate.
- Infringes copyrights, trademarks, or any intellectual property rights of third parties.
- Contains malicious software, spam, or any elements that may harm the Platform's functionality or the devices of other users.
- Includes content unrelated to ceramics.
3. Intellectual Property
- Users retain ownership of the copyrights for the content they publish on the Platform.
- By publishing content, the User grants Smalted a non-exclusive, free, worldwide, and revocable license to use, reproduce, distribute, modify, and display such content for the purpose of operating the Platform and promoting its services.
- The Platform and its associated elements (logos, design, software, etc.) are the property of Smalted and are protected under applicable intellectual property laws. Unauthorized use is strictly prohibited.
4. Content Moderation
- Smalted reserves the right to remove, without prior notice, any content deemed to violate these Terms, applicable laws, or that is deemed inappropriate.
- Users have the right to appeal decisions related to content removal or account suspension by contacting [email protected].
5. Payments and Refunds
- Payments made through the Platform will be processed via the service provider Stripe.
- The Platform assumes no responsibility for issues arising from transactions managed by third parties.
- Refund policies will be subject to the conditions of the events or services contracted, as specified by each organizer.
6. Limitation of Liability
- Smalted provides the Platform "as is" and "as available," without guaranteeing the absence of errors, interruptions, or technical failures.
- The Platform will not be liable for:
- Damages or losses caused by the use or inability to use the Platform.
- Content posted by other Users.
- Losses resulting from transactions conducted through third parties.
7. Modification of Terms
Smalted reserves the right to modify these Terms at any time. Modifications will be published on this page and, unless otherwise stated, will take effect immediately. Continued use of the Platform after the changes are published implies acceptance of the same.
8. Termination of Service
Smalted reserves the right to suspend or cancel accounts of Users who violate these Terms without prior notice.
9. Applicable Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the applicable laws of the jurisdiction where Smalted's headquarters are located. Any disputes arising in connection with these Terms will be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
10. Glaze Safety Notice
The glazes shared on Smalted are user-contributed and may not have been tested for food safety or toxicity. It is the user's responsibility to ensure that any glaze used on functional ware is safe for food contact. Always conduct your own research and follow recommended guidelines for glaze application, firing temperatures, and material safety. Glaze components can pose health risks if misused, and certain combinations may leach harmful substances, especially when used on food surfaces. Smalted and its contributors do not assume any liability for any harm resulting from the use of glazes shared on this site. Always prioritize safety by consulting reliable sources and performing your own tests before using any glaze on functional ware.
